Court Restrains NBA National Leadership From Constituting Caretaker Committee For Lafia Branch
Ten members of the Nigerian Bar Association (NBA) Lafia Branch Executive Committee have secured a court order restraining the national leadership of the association from acting on the decision and recommendation of the NBA Branch Election Appeal Committee (North) made on July 9, 2024, pending the hearing and determination of a motion on notice.
The order, granted by the Nasarawa State High Court, also restrains the Registered Trustees of the Nigerian Bar Association and the NBA President from constituting a caretaker committee to run the affairs of the NBA Lafia Branch until the motion on notice is heard and determined.
The applicants in suit NSD/LF39M/2024 are Onwudiwe Ignatius Martins Esq. (Vice Chairman), Abundaga Nicholas James Esq. (Secretary), Paul Aondoakula Agbatse Esq. (Assistant Secretary), Yakubu Isaiah Andrew Esq. (Financial Secretary), Orgaza Dennis Esq. (Treasurer), Orpin Philip Mtile Esq. (Social Secretary), Alaku Dennis Dauda Esq. (Publicity Secretary), Fauziya Buba Esq. (Welfare Secretary), Mohammed Danjuma Esq. (Legal Adviser), and Jacob E. Abimiku Esq. (Provost).
The respondents in the suit are the Registered Trustees of the Nigerian Bar Association, the NBA President, the Chairman of the NBA Branch Election Appeal Committee (North), the NBA Branch Election Appeal Committee (North), Isah Hassan Nalaraba Esq., and Abdullahi Shuaibu Gayam Esq. (Chairman, NBA Lafia Branch).
The order was granted by Honourable Justice Aisha B. Aliyu, the Chief Judge of Nasarawa State, on July 10, 2024, following the consideration of a motion exparte dated July 9, 2024, and filed on July 10, 2024, at the High Court Registry, Lafia. The motion was supported by a 28-paragraph affidavit deposed to by Onwudiwe Ignatius Martins Esq., the Vice Chairman of the NBA Lafia Branch.
The court has fixed the suit for hearing of the motion on notice on July 26, 2024, before the Honourable Vacation Judge.
