Dr. Wahab Shittu, SAN, on the Judiciary, Tax Reform, and Stampedes in Nigeria

In a recent interview with Vanguard’s Law & Human Rights, Dr. Wahab Shittu, SAN, renowned law teacher and former prosecutor with the Economic and Financial Crimes Commission (EFCC), discussed several pressing issues in Nigeria, including the negative perception of the judiciary, the controversial tax reform bill, and the tragic stampedes that have claimed lives across the country.

On the Suspension of Local Government Chairmen in Edo State:

Dr. Shittu expressed concern over the suspension of 18 local government chairmen in Edo State by Governor Godwin Obaseki for allegedly failing to submit their financial statements. According to Dr. Shittu, the move raises serious legal and constitutional issues, particularly in light of the Supreme Court’s rulings on local government autonomy. He emphasized that local governments, as enshrined in Section 7(1) of the 1999 Constitution, should operate independently, and the power to suspend or remove local government officials should lie with the legislative council, not the governor. He argued that such arbitrary actions undermine democracy and violate the principle of local government autonomy.

On the Attorney-General’s Statement on Local Government Autonomy:

Dr. Shittu supported the Attorney-General of the Federation’s (AGF) warning against state governments passing laws that undermine the autonomy of local governments. He reiterated the importance of adhering to the Supreme Court’s decisions on local government autonomy, urging the Federal Government to enforce these rulings rigorously. Dr. Shittu believes that the autonomy of local governments is crucial for effective grassroots development and for maintaining Nigeria’s federal structure.

On the Call for Withdrawal of the Tax Reform Bill:

Reacting to former Senate Leader Ali Ndume’s call for the withdrawal of the controversial tax reform bill, Dr. Shittu expressed support for tax reforms but acknowledged that there might be areas needing adjustments. He emphasized the importance of consulting stakeholders and ensuring the bill is clearly communicated to the public. He noted that tax reforms can be complex, and there is a need for widespread outreach to explain the reforms, including efforts by tax professionals like Mr. Taiwo Oyedele. Simplifying the tax narrative and fostering public understanding are essential for successful implementation.

On the Growing Negative Perception of the Judiciary:

Dr. Shittu discussed the growing negative perception of Nigeria’s judiciary, attributing it to corruption, delayed justice, conflicting rulings, and a lack of accountability. He called for internal reforms within the judiciary, including strengthening disciplinary measures against erring judges, enhancing transparency, and promoting continuous legal education. He also emphasized the need for collaboration between the judiciary, civil society, and the public to restore trust in the justice system.

On Recent Stampedes in Nigeria:

Dr. Shittu also addressed the recent stampedes in Abuja, Ibadan, and Anambra, which have led to numerous deaths, including those of children. He highlighted the systemic issues behind these tragedies, such as inadequate event management, poor crowd control, and the impatience of attendees. He stressed that event organizers must take responsibility for implementing effective crowd management strategies and security protocols. Dr. Shittu also pointed to the deep social and economic desperation faced by many Nigerians, which exacerbates these situations. He called for better planning, security, and emergency response systems to prevent future stampedes.

Dr. Shittu concluded by urging both authorities and citizens to work together to prevent such tragedies, emphasizing that with proper planning, accountability, and public cooperation, stampedes can be avoided in the future.
