ABA Sues Trump Administration Over “Campaign of Intimidation”
The American Bar Association (ABA) has filed a federal lawsuit against the Trump administration, accusing it of orchestrating a campaign of intimidation against major U.S. law firms in violation of the Constitution.
Filed on Monday in Washington, D.C., the suit challenges a series of executive orders allegedly used to punish firms based on their past clients and hiring practices. The ABA is seeking a court order to halt what it describes as a deliberate attempt to erode the rule of law and silence legal opposition to the administration.
“There has never been a more urgent time for the ABA to defend its members, our profession, and the rule of law itself,” said ABA President William Bay.
The ABA, the nation’s largest voluntary association of lawyers with about 150,000 dues-paying members, said it was forced to act after repeated executive actions by then-President Donald Trump stripped lawyers of security clearances and limited their access to federal officials and contracts.
Four firms have already won separate lawsuits against the administration’s executive orders, securing preliminary or permanent injunctions from federal judges in Washington. One of those firms, Susman Godfrey, is now representing the ABA in this latest case.
Despite these court rulings, nine law firms have entered into agreements with the Trump White House, pledging nearly $1 billion in pro bono legal services in exchange for immunity from similar retaliatory actions.
White House Pushes Back
White House spokesperson Harrison Fields dismissed the suit as “clearly frivolous,” arguing that the ABA lacks standing to challenge the president’s discretionary authority over national security clearances and federal contracting.
“The administration looks forward to ultimate victory on this issue,” Fields said.
Chilling Effect on Legal Representation
According to the ABA, the executive actions have chilled the willingness of firms to take on cases against the federal government, including immigration-related litigation. The association claims the administration’s actions amount to a “deliberate policy designed to intimidate and coerce law firms and lawyers from challenging the president in court.”
Funding Cuts and Broader Tensions
The lawsuit marks a significant escalation in tensions between the ABA and the Trump administration. Over the past year, the White House has moved to cut government support for the association and limit its longstanding influence in vetting federal judicial nominees.
In March, Attorney General Pam Bondi threatened to strip the ABA of its authority to accredit law schools unless it dropped its student diversity requirement. That same month, a federal judge issued a temporary order blocking the Justice Department from canceling $3.2 million in grants used by the ABA to train lawyers assisting victims of domestic and sexual violence.
