Calling on Kano State Government and Hisbah Police To Stop Violating Fundamental Rights Of B.U.K Students, We Are Citizens By Mohammed Ibrahim Abdullahi, COL

My attention was called yesterday, 2nd day of November, 2023 by my course mate, Abdulkadir, popularly known as ‘Dreshkid’, a final year law student at Bayero University, Kano that Kano State Hisbah Police entered his neighbour’s room by using force without their consent or notice, I have watched the video, it’s totally contrary with the provisions of Chapter 4 of the 1999 constitution and we cannot take it.
Every citizen has right to personal liberty as clearly state in the provision of section 35, right to dignity in section 34 and right to privacy in the provision of section 37 of CFRN as amended, they cannot correct others conduct through wrong approach, Hisbah’s action at Danbare Quarters by disturbing students at midnight is legally and morally wrong, it’s uncalled, they just want to attract bad name to our school, school should take necessary action.
Students of Bayero University, Kano has dress code rules enforced by the school authority in line with the public policy of Kano State, the security in Bayero University, Kano do not allow students to wear dress against the school’s rule.
In Islam, you cannot call someone to your religion by using force, there is Qur’anic provision on this, it is well agreed that students from the southern part of the court should comply with the school’s rules by avoiding engaging themselves in what will attract bad name to the school in spite of the fact that there are newly students who are yet to know school’ rules but Hisbah should report to our school authority in case students are misbehaving at off campus but entering students compound is a bad decision, students will start defending themselves as they also have privilege.
In Islam, you cannot accuse a person for adultery without providing four (4) witnesses to prove your allegation according to Qur’an chapter 24 V. 4, and the consequences of failure to provide the required witness is 80 lashes. The purpose of law is to protect the rights and liberties of citizens.
At Danbare Quarters, Hisbah police has on several occasions questioned male students for moving together with a female colleague, when moving together with a lady become an offence? it’s not even morally wrong as nobody can see what is in their mind.
Students will be afraid of staying at off campus close to Bayero University, Kano if Hisbah continue tempering with students’ rights, the video released by the victim is so sad and intimidating. It is all about morally right, Jurisprudentially it is not easy for a layman to understand the relationship between law and morality, moving together with a female is nothing as far as they did not act contrary to the public policy like hugging, kiss and other wrongful act.
Hisbah Police must seek the consent of students before searching their houses, we are calling on Kano State Government and Kano State Hisbah Board to comply with the established procedures of search and arrest in exercising their duties, we cannot question their legality being they are created by the Kano State but our fundamental rights must be protected by the law since we are not living in a lawless society.
