The petitioners are seeking to nullify the election results, alleging non-compliance with the provisions of the Electoral Act and claiming that Okpebholo of the APC did not secure the highest number of lawful votes cast. In a new development, the Independent National Electoral Commission (INEC) produced five additional Bimodal Voter Accreditation System (BVAS) machines used in the election, which were admitted into evidence despite objections from the respondents.
The tribunal had already accepted 148 BVAS from 133 disputed polling units as part of the evidence presented by the PDP.
